Welcome to Kool Design Maker. These Terms and Conditions describe the terms that apply when you purchase or use our graphic design, logo design, website design, website development, printing, and related creative services.

By placing an order with Kool Design Maker, submitting payment, approving a design, or authorizing us to begin work, you acknowledge that you have read and agree to these Terms and Conditions.

Design, Website, and Printing Services

Kool Design Maker provides professional creative and business services to customers throughout the United States. Our services may include logo design, graphic design, website design and development, business card design and printing, brochures, flyers, banners, signs, promotional materials, and other related services.

The exact scope, price, specifications, and estimated turnaround time for a project may vary depending on the service ordered and the requirements provided by the customer.

Customer Satisfaction and Refund Policy

Customer satisfaction is important to Kool Design Maker. If a customer requests a refund for an eligible order, any approved refund may be subject to a 35% administrative fee to cover processing, consultation, design, development, and other resources already allocated to the project.

Refunds May Not Be Available in the Following Situations

1. The customer has approved the design, proof, concept, or final artwork.
2. We have begun working on the project and have completed one or more requested revisions.
3. The customers business closes, changes its name, changes its business activity, or otherwise changes direction after work has started.
4. We do not receive a response or required information from the customer for more than four months.
5. The customer obtains, uses, reproduces, or modifies the design through another designer, agency, developer, printer, or third party.
6. The customer has received all items, artwork, files, or services included in the order.
7. More than 90 days have passed since the original order date.
8. Final website files, source code, or completed website content have been deployed, transferred, or uploaded to the customers server or hosting account.
9. A printing order has entered production or has already been printed.
10. A custom product has been produced according to artwork or specifications approved by the customer.

Kool Design Maker reserves the right to review refund requests individually. Any approved refund may be adjusted based on the work completed, resources used, administrative costs, third-party expenses, and other costs associated with the project.

Refund Limitations

Any approved refund is limited to the eligible amount paid for the original order. Kool Design Maker is not responsible for indirect, incidental, special, or consequential losses resulting from project delays, delivery delays, business interruptions, lost opportunities, or other circumstances related to an order.

Unless otherwise agreed in writing, shipping charges, postage, delivery charges, domain registration fees, hosting fees, SSL fees, third-party software fees, stock image fees, payment processing costs, and other third-party expenses are nonrefundable once incurred.

How Approved Refunds Are Processed

When a refund is approved, we generally return the eligible amount to the original payment method whenever possible.

Credit card refunds may take several business days to appear on the customers account after they are processed. Processing times are controlled by the customers bank, credit card company, payment processor, or other financial institution and are outside the control of Kool Design Maker.

Design Proofs and Customer Approval

Customers are responsible for carefully reviewing all design proofs before providing approval. This includes checking names, addresses, telephone numbers, email addresses, website addresses, spelling, grammar, colors, sizes, quantities, layout, images, and other project information.

Once a customer approves a final design or printing proof, Kool Design Maker may proceed with production. Changes requested after final approval may result in additional design, production, reprinting, or shipping charges.

Printing Orders

Customers must carefully review and approve printing proofs before production begins. Once a printing order enters production, it generally cannot be canceled, modified, or refunded.

Printed colors may vary slightly from colors displayed on computer monitors, mobile devices, office printers, or other screens. Differences can result from monitor calibration, printing processes, paper or material selection, ink, finishing methods, and other production factors.

Minor variations that are considered normal within commercial printing standards do not necessarily constitute a printing defect.

Shipping and Delivery

Shipping and delivery dates are estimates unless otherwise specifically guaranteed in writing. Kool Design Maker is not responsible for delays caused by shipping carriers, weather conditions, natural disasters, incorrect customer addresses, transportation disruptions, or other circumstances outside our reasonable control.

Customers are responsible for providing an accurate and complete shipping address before an order is shipped.

Website Design and Development

Website projects require timely cooperation from the customer. The customer is responsible for providing required text, photographs, logos, product information, account credentials, approvals, and other materials necessary to complete the website.

Website completion dates may change when content, approvals, access credentials, or revision instructions are delayed.

Unless otherwise stated in the project agreement, third-party services such as domain registration, website hosting, SSL certificates, premium plugins, themes, software subscriptions, APIs, payment gateways, and external platforms may have separate terms, fees, and renewal requirements.

Revisions and Change Requests

Revisions are intended to refine the design or service originally ordered. Requests that substantially change the original project scope, concept, functionality, number of pages, content, or specifications may be considered additional work and may require an additional fee.

Kool Design Maker will inform the customer when a requested change falls outside the original project scope and requires additional charges.

Inactive and Stale Projects

During a project, Kool Design Maker may contact the customer regarding content, revisions, approvals, scheduling, or other information required to continue the work.

If the customer does not provide necessary feedback, content, approval, or revision instructions for 28 days, the project may be classified as inactive and archived. An inactive project may be subject to a $35 USD reactivation and unarchiving fee.

If the customer does not communicate with Kool Design Maker regarding an active project for more than 90 days, the project may be closed and removed from active production. Payments, deposits, or retainers already applied to work performed may become nonrefundable.

Restarting a project after 90 days may require a new project agreement, updated pricing, additional payment, or a new deposit based on our current rates and availability.

Intellectual Property and Ownership

Unless otherwise agreed in writing, preliminary concepts, unused designs, drafts, mockups, development concepts, source materials, and rejected design options remain the intellectual property of Kool Design Maker.

Rights to the final approved design or deliverables are transferred to the customer only after all applicable project payments have been received in full and subject to any third-party licensing restrictions.

Fonts, photographs, stock images, software, plugins, themes, templates, code libraries, and other third-party materials may remain subject to the licenses and ownership rights of their respective creators or providers.

Stock Images, Fonts, and Third-Party Materials

Kool Design Maker may use royalty-free, customer-supplied, licensed, or placeholder images and other third-party resources during the design process.

If a project requires a premium stock photograph, font, illustration, video, plugin, theme, or other licensed asset that is not included in the quoted project price, the customer may be required to purchase the appropriate license or reimburse the applicable licensing cost.

Customers who provide photographs, logos, text, graphics, videos, trademarks, or other materials represent that they have the necessary rights or permission to use those materials. Kool Design Maker is not responsible for copyright, trademark, licensing, or ownership claims arising from materials supplied or specifically requested by the customer.

Customer Content and Accuracy

Customers are responsible for the accuracy, legality, and ownership of information and materials they provide. Kool Design Maker may assist with proofreading and presentation, but the customer remains responsible for approving final content before publication, printing, or production.

Project Turnaround Times

Estimated turnaround times are based on the requirements of the project, our current production schedule, and previous project experience. Unless specifically guaranteed in writing, turnaround times are estimates and not guaranteed delivery dates.

Projects can generally be completed more efficiently when customers provide content promptly, submit clear instructions, review proofs quickly, and provide consolidated revision requests.

Turnaround times may increase because of delayed customer responses, extensive revisions, changes to the original project scope, delayed approvals, third-party services, printing production schedules, shipping delays, or circumstances outside our reasonable control.

Prohibited Content and Services

Kool Design Maker reserves the right to refuse projects involving illegal content, fraudulent activities, intellectual property infringement, or other content that we determine we cannot reasonably or lawfully provide services for.

We do not provide design, development, or related creative services for pornographic content.

Limitation of Liability

To the extent permitted by applicable law, Kool Design Maker will not be liable for indirect, incidental, special, consequential, or business-related losses resulting from the use of our services, project delays, printing delays, shipping delays, website downtime, third-party services, or customer-provided materials.

To the extent permitted by applicable law, the total liability of Kool Design Maker relating to a specific order will not exceed the amount actually paid to Kool Design Maker for the specific service giving rise to the claim.

Changes to These Terms and Conditions

Kool Design Maker may update these Terms and Conditions periodically to reflect changes to our services, business practices, or applicable requirements. Updated terms will become effective when published on this website unless otherwise stated.
